ON NOGRALES THE RESOLUTION

If the House of Representatives passes the Nograles resolution by mere majority vote, then it will be unconstitutional. We are not allowed to conflate an ordinary bill with a charter change resolution. There is simply no correspondence between the two measures.

If the Nograles resolution is limited to economic provisions, then it is only an amendment, and not a revision. An amendment is limited only to specific provisions. Revision covers the entire Constitution.

But whether amendment or revision, the vote required is three-fourths of all the members of Congress. Any vote less than three-fourths is unconstitutional. For example, to pass a charter change resolution in the same way as an ordinary bill – by mere majority vote – is unconstitutional.

The reason for this is that the power of charter change is NOT part of the legislative power of Congress. Instead, the power of charter change is part of the inherent power of the people, who have spoken through the Constitution.

The power of Congress to pass laws is derived from its legislative power. By contrast, the power of Congress on charter change is derived from the Constitution. This difference was emphasized by the Supreme Court in the 1967 case of Gonzales v. Comelec.

The Constitution provides for charter change under Article 17 entitled “Amendments of Revisions.” The Constitution does not include charter change under Article 6 entitled “Legislative Department.” This is textual proof that a charter change resolution should not be treated like an ordinary bill. It would be like comparing a dilis to a whale.

The Nograles resolution, even if it follows the Rules of Procedure of the House of Representatives, is unconstitutional. By requiring only a majority vote, it contravenes the constitutional provision that charter change should pass by a three-fourths vote.

Maraming salamat po Senadora Meriam Defensor santiago. Dahil po kayo lamang ang tanging government official na talagang nagbigay pansin ang pagpapahirap ng CREDIT CARD COMPANY sa mga taong bayan. Higit sa lahat ang mga empleyado na grabeng problema sa pagbayad sa sobra-sobrang interest ng mga suwapang na credit card company. Sana po matulungan po ninyo ang lahat ng credit card holders na wala nang principal na utang na patuloy sinisingil ng credit card company na puro patong-patong na interest sa pag suma total malaki pa ang bayad namin sa interest kesa sa principal amount.

Itong mga credit card company dapat sumailalim rin sa AMLA dahil higit pa sila sa terorista. Hirap na ang tao pinapatungan pa ng doble-doble na interest na wala nang kabuluhan.

Mahal na Senadora kayo lamang ang tanging matapang na Senadora na tanging makakatulong sa mga hirap na hirap na mga empleyado na niloloko ng mga credit card company.

Sana po matulungan kaming naghihirap dahil sa credit card :

1. Sana po ma wave na yung wala ng utang Principal at sobra sobra na ang bayad.

2. Sana ma verify ang mga collecting agent/law offices na halos 100% ang patong na interest.

Kapos na kapos na po ang mga ordinaryong credit card holders na pinag lalaruan ng mga credit card company.

Una po sa lahat, gusto ko po kayong batiin dahil sa magaganda pong hangarin niyo para sa ating bansa.

Bilang isang Pilipino, gusto ko po ipaalam sa inyo na alam ko po at nakikita ko kung ano ang mga nangyayari sa ating bansa. At napapansin ko ang malaking kakulangan hindi lang sa systema ng ating Gobyerno kundi ganyon na rin sa ating kapwa-Pilipino. Kung babasihan ko nga lang po ang ating media, halos wala na po kaming mabasa o makita kundi paninira sa ating mga politiko. Gayon pa man, pingdadasal ko po, na wag po kayong magsawa sa pag gawa ng mabuti at pag gawa ng mga naaayon na batas para sa ating bansa.

Mabuhay po kayo at sana, pag dating ng panahon e makilala ko po kayo ng personal.
